Terms of Use

These Terms of Use ("Terms") govern your access to and use of hydralogistics.ro (the "Site"), operated by HYDRA LOGISTICS S.R.L. By accessing or browsing the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. Our Privacy Policy also applies and is incorporated into these Terms by reference.

1. About the Site

The Site is operated by:

The Site is an informational business website presenting our company and road freight carrier services across the European Union. It does not function as an online shop, booking system, or contract-execution platform.

2. No binding offer

The content of the Site - including descriptions of services, capacity figures, experience statements, statistics, and any information provided in the FAQ - is presented for general informational purposes only. Nothing on the Site constitutes a binding commercial offer, a guarantee of availability, or a formation of contract under Romanian or EU law.

All transport services are provided exclusively under separate written agreements (transport orders, framework contracts, CMR consignment notes) individually negotiated with each client. The terms of those agreements - not the content of the Site - govern our contractual obligations.

We make reasonable efforts to keep the Site accurate and up to date, but we do not warrant that every piece of information is free from error or that descriptions of services, fleet capabilities, or operational details always reflect our current status.

3. Transport services & contracts

Our road freight services are subject to:

• The specific transport order or contract concluded between Hydra Logistics and the client;
• The Convention on the Contract for the International Carriage of Goods by Road (CMR Convention, 1956), as ratified by Romania, for international shipments;
• Romanian transport and commercial law, including but not limited to the Romanian Civil Code and applicable sectoral regulations;
• Applicable European Union transport regulations (e.g. Mobility Package provisions, cabotage rules, driver hours regulations).

Any cargo insurance coverage, liability limits, delivery windows, and claim procedures are set out in the individual transport contract or order. General statements on the Site (for example, that we operate 3.5-ton vans or accept diverse cargo types) do not override the specific terms agreed in a given shipment.

4. Acceptable use

You agree to use the Site only for lawful purposes. You must not:

• Attempt to interfere with, disrupt, or gain unauthorized access to the Site, our servers, or any connected infrastructure (including the carrier portal);
• Use automated systems - scrapers, crawlers, bots - to harvest data from the Site beyond what general search engines do for indexing;
• Misrepresent your identity or impersonate Hydra Logistics;
• Copy, reproduce, modify, or distribute the Site's content for commercial purposes without our prior written permission;
• Use the Site to transmit malware, phishing attempts, spam, or any other harmful content;
• Circumvent security measures, authentication mechanisms, or access controls.

5. Intellectual property

All content on the Site - including but not limited to the "Hydra Logistics" name, logo, brand identity, text, graphics, layout, design, code, photography, and iconography - is the property of HYDRA LOGISTICS S.R.L. or its licensors and is protected by Romanian and international intellectual property laws.

You may view and share links to the Site. You may not otherwise copy, reproduce, republish, distribute, modify, or create derivative works from any part of the Site without our prior written consent. Any unauthorized use may result in legal action.

"Hydra Logistics" and the associated logo are trademarks of HYDRA LOGISTICS S.R.L.

6. Third-party links

The Site contains a limited number of links to external destinations, including Google Maps (for our office location) and our separately operated carrier portal. We do not control and are not responsible for the content, policies, or practices of any third-party service linked from the Site. Accessing a third-party link is at your own risk, and their own terms and privacy policies will apply.

7. Carrier portal

The Site links to portal.hydralogistics.ro, a separate authenticated application used by our carrier partners and internal team. The Portal is governed by its own terms of use and access conditions, which are provided to authorized users upon account issuance. These Terms apply only to the public-facing Site at hydralogistics.ro and do not regulate Portal usage.

8. Disclaimer of warranties

The Site is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or harmful components. You use the Site at your own risk.

This disclaimer does not apply to, and does not attempt to exclude, any liability for death, personal injury caused by negligence, fraud, or any other liability which cannot be excluded or limited under applicable Romanian and EU law.

9. Limitation of liability

To the fullest extent permitted by law, HYDRA LOGISTICS S.R.L. and its directors, employees, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages - including loss of profits, loss of business, loss of data, or loss of goodwill - arising out of or related to your use of, or inability to use, the Site.

Our total aggregate liability arising from or related to your use of the Site (excluding liability arising from actual transport services, which is governed by the relevant transport contract and the CMR Convention) is limited to the maximum extent permitted by law.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Romanian or EU consumer-protection law.

10. Indemnification

You agree to indemnify, defend, and hold harmless HYDRA LOGISTICS S.R.L. and its directors, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or your unlawful use of the Site.

11. Availability & changes

We may modify, suspend, or discontinue the Site - in whole or in part - at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

We may also update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

12. Governing law & jurisdiction

These Terms and any dispute arising out of or related to them or to your use of the Site are governed by the laws of Romania, without regard to its conflict-of-laws principles.

Any dispute shall be subject to the exclusive jurisdiction of the competent courts of Pitesti, Arges County, Romania, subject to mandatory consumer-protection rules of EU law that may grant you the right to bring proceedings in your country of residence.

If any provision of these Terms is held unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
